1. Booking and confirmation – find our terms & conditions
With your registration, which can be done in writing, verbally or by telephone, you offer the organizer ITALIA ON TOUR the conclusion of a binding contract. If the booking for possible fellow travelers is made by the registrant, he is liable, as for his own contractual obligation, also for that of the fellow travelers, if no separate regulation has been made. The travel contract becomes binding for the organizer when he confirms the booking and the price in writing by post, fax or email. If the confirmation differs from the registration, the organizer is bound to the new offer for one week. According to the new offer, the hotel booking is made if you accept it within one week.
2. Payment – Terms & Conditions Italia On Tour
When concluding the contract, a deposit of usually 20% is to be paid after receipt of the booking confirmation, and in the case of short-term trips from 4 weeks before the start of the trip, the full total amount is to be paid. The cost of travel insurance is due in full along with the deposit. The remaining payment is made 4 weeks before departure. Payments are to be made in each case by bank transfer. 3. Services / Prices – Italia On Tour
The services that are contractually agreed can be found in the offer and the information in the booking confirmation. The information in the service descriptions are generally binding for the organizer with the content with which they have become the basis of the travel contract. Before the contract is concluded, the organizer can change the service descriptions at any time, about which the customer will of course be informed.
4. Changes in services and prices
Changes and deviations of individual travel services from the agreed content of the travel contract, which become necessary after conclusion of the contract and which were not brought about by ITALIA ON TOUR in bad faith, are only permitted insofar as they are not significant and do not affect the overall design of the booked service. Warranty claims remain unaffected insofar as the changed services are defective. The organizer is obliged to inform the customer immediately about changes or deviations in services. If necessary, he will offer the customer a free rebooking or a free cancellation. In the event of a subsequent change in the hotel price, the organizer must inform the customer immediately. Price increases from the 20th day before departure are ineffective. In the event of price increases of more than 5%, the customer is entitled to withdraw from the contract without charges or to request a rebooking to a hotel of at least the same value, if the organizer is able to offer such a hotel from its offer at no additional cost to the customer. An increase is only permitted if there are more than 4 months between the conclusion of the contract and the agreed travel date and the circumstances leading to the increase did not occur before the conclusion of the contract and were not foreseeable by the organizer when the contract was concluded. The customer must assert these rights immediately after the organizer has declared about the price increase or change in the hotel service. The mutual rights and obligations mentioned in this paragraph also apply in the event of a permissible change to an essential travel service.
5. Rebooking, cancellation
At your request, the organizer will be happy to change the service (rebooking) up to the 31st days before the start of the trip, if this is feasible. Depending on the workload, between € 15.00 and € 30.00 per person will be charged. Changes to the travel date, the accommodation and the number of people are considered rebooking. Thereafter, the general cancellation conditions apply. See point 12.
6. Special requests, individual travel arrangements
The organizer only accepts special requests if they are designated as non-binding. The organizer endeavors to meet your request for special services that are not advertised in the catalog, e.g. rooms adjacent to one another or rooms in a certain location. Written confirmations are not issued.
7. Travel Extension
If you would like to extend your stay, please contact the ITALIA ON TOUR support on site as early as possible. We will be happy to extend your stay if appropriate accommodation is available. The costs for an extension are to be paid on site.
8. Unused services
If the customer does not make use of individual travel services due to an early return trip or for other compelling reasons, the organizer will endeavor to reimburse saved expenses upon application to the hotel. This is not necessary if the unused services are completely insignificant or if a reimbursement is contrary to legal or official regulations.
9. Tour guide, support
Telephone support is provided on site in the hotels offered by ITALIA ON TOUR. Our office is on the island of Ischia in the Campania region. For customers who are on holiday in Ischia, an appointment can be made for a personal visit to the hotel. For address and telephone numbers, please refer to your travel confirmation or travel documents.
10. Remedy / reduction / termination
If a hotel service is not provided or not provided in accordance with the contract, the customer can request remedial action. In the event of complaints, you are obliged to report them immediately on site. The organizer can also remedy the situation by providing an equivalent or higher-quality replacement service. The organizer can refuse the remedy if it requires a disproportionate effort. After returning from the trip, the customer can demand a reduction in the price of the trip if the travel services have not been provided in accordance with the contract and he does not neglect to report the defect. If the customer culpably fails to report the defect, claims for a reduction in price and contractual claims for damages are therefore excluded. If the hotel visit is significantly impaired as a result of a defect and the organizer does not provide a remedy within a reasonable period of time, the customer can cancel the hotel booking within the framework of the statutory provisions – in his own interest and for reasons of evidence, written form is recommended. It is not necessary to set a deadline for remedial action if remedial action is impossible or is refused by the organizer or if the immediate termination of the contract is justified by a special interest of the traveler. If the contract is subsequently canceled, the customer only owes the organizer the amount for the services used.
11. Withdrawal and termination by the tour operator – Italia On Tour
ITALIA ON TOUR can terminate the contract without notice if the customer’s stay in the hotel is permanently disrupted by the customer despite a corresponding warning from the organizer. The same applies if the customer behaves contrary to the contract to such an extent that the immediate cancellation of the contract is justified. However, the organizer retains the right to the travel price. Any additional costs for the return transport are borne by the disturber himself. The organizer must, however, offset the value of saved expenses as well as those advantages that are obtained from another use of unused services, including any reimbursements by the hotel. The organizer can withdraw from the trip up to 4 weeks before the start of the trip if the minimum number of participants specified in the respective service description and in the travel confirmation is not reached. The organizer will of course inform the customer if it becomes apparent at an earlier point in time that the minimum number of participants cannot be reached, or the booked hotel opens at a later point in time or closes earlier. You will receive the deposit back immediately. However, the organizer has no right of withdrawal if he is responsible for the circumstances leading to this (e.g. calculation errors) or if he cannot prove these circumstances. The resignation will be forwarded to the traveler immediately. In the event that the organizer withdraws, the traveler is entitled to request accommodation in another hotel of at least the same value, if the organizer is able to offer such a hotel from its offer at no extra charge to the customer. The customer has to assert this right to the organizer immediately after the cancellation is made. If the customer does not exercise his right to accommodation in an equivalent hotel, he will immediately receive the paid travel price back.
12. Withdrawal and termination by the traveler before the start of the journey
Cancellation fees
The flat-rate entitlement to cancellation fees is usually per person / per accommodation unit in the case of cancellations

13. Children’s discounts
The age at the start of the journey is decisive. Regardless of this, the age of each child traveling with you must be specified when booking. Please refer to our website for the extent of the child discounts. If the age is incorrect, ITALIA ON TOUR is entitled to collect the differences based on the correct travel price plus a processing fee of € 30.-.
13. Children’s discounts
The age at the start of the journey is decisive. Regardless of this, the age of each child traveling with you must be specified when booking. If the age is incorrect, ITALIA ON TOUR is entitled to collect the differences based on the correct travel price plus a processing fee of € 30.-.
14. Special information for holiday apartments and residences
As a rule, electricity, water and gas are included in the price unless otherwise noted in the catalog. The final cleaning is to be paid extra on site. The holiday apartment / residence may only be occupied by the number of adults and children specified on the website and listed in the travel confirmation. Pets are only allowed in those cases in which this is expressly stated. The specified arrival and departure dates are binding. Each guest undertakes to properly treat the residential unit and the inventory and any communal facilities. He is also obliged to compensate for the damage incurred during the stay through his fault or the fault of his companions and guests. When the keys are handed over, an appropriate deposit can be requested as security for any damage. The repayment or offsetting takes place if the residential unit and the inventory have been left in a proper condition at the end of the stay.
15. ID – How to enter in Italy
An identity card (passwort) is sufficient to enter Italy.
16. Exclusion of claims
The assignment of claims against the organizer is excluded. This does not apply to accompanying family members. Limitation and assignment of claims due to non-contractual provision of the trip must be asserted against ITALIA ON TOUR within one month after the contractually stipulated end of the trip. This should be done in writing in your own interest. After the deadline, the traveler can only assert claims if he was prevented from complying with the deadline through no fault of his own.
17. Data protection
The personal data that you provide to us will be processed and used electronically insofar as they are necessary for the execution of the contract and will not be passed on to third parties.
18. Insolvency protection insurance
We are only entitled to demand payment of the travel price from you if it is ensured that in the event of failure of travel services due to insolvency or insolvency of the tour operator, the travel price paid and the necessary expenses for the return journey will be reimbursed (Section 651K BGB). Accordingly, we have insured against this risk of insolvency with the insurer Reisegarant. The security certificate, which guarantees you a direct claim in the event of insolvency or bankruptcy, will be sent to you with the booking documents at the latest.
19. Travel coverage
Please note that the travel price does not include travel cancellation insurance or additional cost insurance (replacement trip). Cancellation before the start of the trip incurs cancellation costs and additional costs on site if the trip is interrupted. You can cover these with insurance. We recommend our customers to take out special travel insurance from Europäische Reiseversicherung AG. 20. Place of jurisdiction
Italian law applies. Place of jurisdiction in Naples.
